Legal Counsel, Trust and Fiduciary Services 

We are currently seeking an experienced lawyer individual to join this team in the role of Legal Counsel, Trusts and Fiduciary Services (TFS)

 Role purpose

  • Provide support on a broad range of legal issues relating to or arising out of the TFS CI business including matters that may be complex or may have material impact.
  • To be considered as a trusted adviser to the TFS CI business, by ensuring that commercially sensitive, pragmatic, practical and strategic legal support and advice is provided in a cost-effective manner to the TFS CI business.
  • Assisting in the identification of legal risks in the TFS CI business and appropriate risk mitigation strategies.
  • Provide support and guidance to the rest of the CIIOM Legal Team as required. 
  • Execute against relevant policies and procedures for the relevant area of coverage to ensure that Legal’s role in the second line of defence can be executed.
  • Evaluating and responding to changes in legal and regulatory requirements as they arise. To horizon scan for potential emerging legal risks ensuring appropriate action by the TFS CI business.

 Role Accountabilities

  • Provide legal support within the assigned area of responsibility and on a variety of legal matters including matters that may be complex or have potential for significant impact.
  • To be considered a trusted adviser to the business by ensuring that commercially sensitive, pragmatic, practical and strategic legal support and advice is provided in a cost-effective manner to the CIIoM businesses.
  • Support the General Counsel CIIoM in implementing legal policies to ensure that the Group’s exposure to legal risks is managed appropriately within the CIIoM businesses.

Stakeholders

  • Provide high quality specialised legal and regulatory advice, guidance and support to the CIIoM businesses.
  • Manage the provision of prompt, commercial, practical and often complex and / or specialised legal advice to the CIIoM businesses.
  • Be proactive in the provision of legal support and in advising the business promptly of material legal developments and their implications.
  • Assist in managing the relationships with panel law firms/ external legal counsel.

 Required Knowledge & Qualifications

  • Qualified Solicitor or Barrister with at least two years of PQE. Preference will be given to those with a Jersey or Guernsey qualification.
  • Knowledge and experience of non-contentious Jersey trusts law and practice and private client work is essential. International trusts and private client work (in particular offshore experience in jurisdictions including Guernsey, the BVI and the Cayman Islands), as well as contentious experience, will also be beneficial. 
  • Knowledge and experience of banking, finance and corporate law in the major jurisdictions in which TFS operates is also desirable.
  • Ability to learn quickly about the HSBC Group corporate structures, its business and personnel and develop a clear understanding of HSBC’s corporate culture.
  • Strong ability to deal with a number of stakeholders and to prioritise a demanding workload in terms of legal risk and commercial consideration.
  • Communication and inter-personal skills with the ability to adapt communication style and content to appropriately address the management level of the audience.
  • Lateral thinking/problem solving and the ability to understand the relationships between a range of complex issues and the impact of those issues from a legal, financial and reputational perspective to advise client and reach a solution.
  • Ability to think and advise strategically taking into consideration a wide range of issues.
  • Ability to keep up-to-date with key legal and regulatory developments impacting the TFS CI business and to advise the business accordingly to ensure ongoing compliance.
